Free access to public information

The Law on Free Access to Public Information provides access to public information created or held by the Ministry of Information Society and Administration. The applicant may request access to the information orally, in writing or in an electronic record, whereby a request submitted in electronic form is considered a written request. The Written Request may be submitted to the Ministry directly at the archive; by mail to the address of the Ministry (11 Filip Vtori Makedonski Street, Skopje), as well as submitted in electronic form (via e-mail: olivera.jakshikj.trantalovska@mdt.gov.mk). The request for access to public information may be submitted on the established Request Form (given below) or on a regular sheet of paper, but on the same the applicant is obliged to state that it is a Request based on the Law on Free Access to Public Information. The applicant is not obliged to justify the request. In the event that the request is submitted by an authorized representative, a proper power of attorney must be attached to the request. When the requester requests access to information by oral request, the official shall draw up a record thereof. According to Article 10 of the Law on Free Access to Public Information, Official Gazette of the Republic of Macedonia, No. 101 of 22.5.2019

(1) The holder of information is obliged to inform the public through its website by publishing:

- data on its responsibilities that it performs, i.e. those determined by law,

- basic contact data with the holder of the information, namely: name, address, telephone number, fax number, e-mail address and website address,

- data about the official or responsible person at the holder of the information (biography, contact data and other),

- basic contact data with the official for mediating information, namely: name and surname, e-mail address and telephone number, Official Gazette of the Republic of Macedonia, No. 101 of 22.5.2019 5 of 16

- basic contact information for a person authorized for protected internal reporting, namely: name and surname, e-mail address and telephone number,

- list of persons employed by the information holder with position, official e-mail and official telephone number,

- laws relating to the competence of the information holder, related to the register of regulations published in the official gazette,

- regulations that the information holder adopts within its competence in the form of a by-law: rulebooks (rulebook on internal organization, rulebook on systematization of jobs, rulebook on protected internal reporting and others), decrees, orders, instructions, plans, programs, decisions and other types of acts for the implementation of laws and other regulations, when authorized by law,

- organogram for internal organization,

- strategic plans and strategies for the work of the information holders,

- annual plans and work programs,

- annual Budget and final account,

- annual financial plans by quarters and programs for budget implementation,

- audit report,

- types of services provided by information holders (information on physical accessibility for the provision of services and information on e-services, data on legal bases, name of services, documents and data required for the provision of each service, mechanisms for legal protection and other relevant data),

- tariff lists for fees for issuing real acts,

- the manner of submitting a request for access to information (method of submitting an oral and written request for access to information, as well as a request submitted electronically),

- the entire documentation for public procurement, concessions and public-private partnership agreements,

- proposal of programs, programs, positions, opinions, studies and other similar documents relating to the acts within the competence of the information holder, announcements to the public for matters taken from their website in accordance with the legal competences, information bulletins, official gazettes if they are an obligation in accordance with the law and other,

- work reports submitted to the bodies competent for conducting control and supervision,

- statistical data on the work, as well as other information, acts and measures that affect the life and work of citizens and that arise from the competence and work of the information holder and

- other information that arises from the competence and work of the information holder.

 

(2) Every information holder is obliged to provide free access to the information referred to in paragraph (1) of this Article.
